The short version: be decent, review what the AI gives you before you post it, memes belong to their creators, Pro renews monthly until you cancel, and the Service comes without guarantees. The long version below is what actually applies.
1. Agreement
These Terms of Service ("Terms") are a binding agreement between you and Beastify ("we", "us"). They govern your access to and use of beastify.xyz, its websites, apps, APIs, MCP server, agent skill and related services (the "Service"). By using the Service, creating an account, or clicking to accept, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
If you use the Service on behalf of a company or other organization, you represent that you have authority to bind it, and "you" includes that organization.
2. Eligibility
You must be at least 16 years old (or the age of digital consent in your country, if higher) and able to form a binding contract. The Service is not directed to children. You may not use the Service if you are barred from doing so under applicable law or if we previously terminated your account.
3. What the Service does (and doesn't)
Beastify uses automated systems, including third-party artificial intelligence models, to analyze text you submit, suggest rewritten versions, and generate memes from templates. Output is generated automatically and may be inaccurate, incomplete, unoriginal, similar to output produced for others, inappropriate or offensive. You are solely responsible for reviewing all output before you use, publish or rely on it.
Scores, verdicts and suggestions are editorial heuristics. They are not predictions, and we make no promise that using the Service will increase reach, engagement, followers, revenue or any other outcome. Nothing in the Service is professional, legal, financial or other advice.
Beastify is not affiliated with, endorsed or sponsored by X Corp. "X" and "Twitter" are trademarks of their respective owners. You are responsible for complying with the rules of any platform where you post content created with the Service.
4. Accounts and security
Some features require an account. Give accurate information and keep your password and API keys confidential. You are responsible for all activity under your account and keys, whether or not you authorized it. Tell us immediately at [email protected] if you suspect unauthorized access. One account per person; accounts and keys may not be shared, sold or transferred.
5. Plans, billing and cancellation
Free. The free plan includes a limited number of uses per day. We may change free limits and features at any time.
Pro subscription. Pro is billed in advance on a recurring monthly basis at the price shown at checkout (currently US$9.99 per month, plus applicable taxes). Your subscription renews automatically each month and your payment method is charged until you cancel. Payments are processed by Stripe; we do not store your full card details. You authorize us and Stripe to charge your payment method for all fees.
Cancellation. You can cancel at any time from your dashboard (Manage plan). Cancellation takes effect at the end of the current billing period; you keep Pro until then and will not be charged again.
Refunds. Except where required by law, payments are non-refundable and there are no refunds or credits for partial periods, unused features or downgrades. If you are a consumer in the EU, UK or another jurisdiction with a statutory right of withdrawal, you expressly request that we start providing Pro immediately upon purchase and acknowledge that you lose your right of withdrawal once the service has been fully performed; where the law gives you a partial refund instead, we will honor it.
Price changes. We may change prices with at least 14 days' notice before your next renewal. If you don't agree, cancel before the change takes effect.
Failed payments and chargebacks. If a payment fails, we may downgrade or suspend Pro. Initiating an unjustified chargeback may lead to termination of your account.
6. Fair use of “unlimited”
"Unlimited" means no fixed daily cap for normal personal or professional use, including heavy daily use and reasonable automation through the API. To protect the Service, we apply technical fair-use ceilings and may throttle, suspend or require changes to usage that is abusive, automated at a scale that degrades the Service for others, intended to resell or redistribute the Service, or that otherwise exceeds what a reasonable user would need.
7. API, MCP server and agent skill
Pro subscribers may access the Service programmatically. In addition to the rest of these Terms:
- Keep API keys secret and server-side. You are responsible for all requests made with your keys.
- Don't resell, sublicense or offer the API as a standalone service, and don't use it to build a competing product or to train or benchmark machine-learning models.
- Respect rate limits and don't try to circumvent them, including by creating multiple accounts.
- When your agent or application publishes output, you remain responsible for that output as if you had published it yourself.
We may change, version, limit or discontinue the API, MCP server or skill at any time. We will try to give reasonable notice of breaking changes but are not obliged to.
8. Acceptable use
You agree not to use the Service to create, publish or facilitate:
- anything illegal, or that infringes or misappropriates anyone's intellectual property, privacy or publicity rights;
- harassment, threats, bullying, hate speech, or content that demeans people based on protected characteristics;
- sexual content involving minors (we report it), non-consensual intimate content, or sexually explicit content;
- disinformation intended to deceive, election or civic manipulation, impersonation, or content that falsely implies endorsement;
- spam, fake engagement, coordinated inauthentic behavior, or anything that violates the rules of X or other platforms;
- defamation, doxxing, or content targeting private individuals;
- malware, phishing or fraud.
You also agree not to: probe, scan or test the vulnerability of the Service; scrape it or access it by automated means other than the official API; reverse engineer it except where the law allows; interfere with its operation; or circumvent usage limits, for example by rotating identifiers or creating multiple accounts.
9. Your content and output
You keep whatever rights you have in the text and captions you submit ("Input"). As between you and us, and to the extent permitted by law, you own the rewritten text and memes generated for you ("Output"), subject to third-party rights in meme templates (see below). Because outputs are automated, similar or identical output may be provided to others, and you may not have exclusive rights in it.
You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce and display Input and Output only as needed to operate, secure, improve and support the Service, and as described in the Privacy Policy. We do not sell your content and do not use it to train our own AI models.
You represent that you have all rights needed to submit Input and that your Input and your use of Output comply with these Terms and the law.
10. Meme templates and third-party rights
Meme templates are images and video clips that originate from third parties and circulate widely online. They are made available for commentary, criticism and parody. We do not own most templates and we grant no license to them. We make no representation that any template, or any meme you create, is free of third-party rights or may be used for any particular purpose, including commercial or advertising use. You are solely responsible for making sure your use of templates and memes is lawful (for example, under fair use or similar exceptions) and for obtaining any permissions you need.
Copyright complaints. If you believe material available through the Service infringes your copyright, send a notice to [email protected] including: your contact details; identification of the work; identification of the material and where it is located (URL); a statement of good-faith belief that the use is not authorized; a statement, under penalty of perjury, that the information is accurate and that you are the owner or authorized to act; and your physical or electronic signature. We may remove material and will terminate repeat infringers where appropriate. If your material was removed and you believe it was a mistake, you may send a counter-notice with the equivalent information.
11. Third-party services
The Service relies on third-party providers (for example AI model providers, hosting, storage, databases and payments) and may link to third-party sites such as X. We are not responsible for third-party services, their availability, or their terms and privacy practices.
12. Disclaimers
To the maximum extent permitted by law, the Service and all output are provided "as is" and "as available", with all faults and without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment, and any warranties arising from course of dealing or usage. We do not warrant that the Service will be uninterrupted, secure, error-free or free of harmful components, that output will be accurate, appropriate, original or lawful, or that any data will be preserved. Some jurisdictions don't allow certain disclaimers, so some of these may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, in no event will Beastify, its owners, affiliates, contractors or suppliers be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, followers, reputation, goodwill, data or business opportunity, arising out of or relating to the Service, output or these Terms, however caused and under any theory of liability, even if advised of the possibility of such damages.
Our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amounts you paid us for the Service in the 12 months before the event giving rise to the claim, and (b) US$50.
Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for fraud, or for death or personal injury caused by negligence where such limits are prohibited.
14. Indemnification
To the extent permitted by law, you will defend, indemnify and hold harmless Beastify and its owners, affiliates and contractors from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising out of or relating to your Input, your use of output (including memes and posts you publish), your use of the Service or API, or your violation of these Terms, the law or any third-party right.
15. Suspension and termination
You may stop using the Service and delete your account at any time from your dashboard. We may suspend or terminate your access, remove content, or refuse service at any time, with or without notice, if we reasonably believe you violated these Terms, created risk or legal exposure, or if we discontinue the Service. If we terminate Pro for reasons other than your breach, we will refund the unused portion of your current billing period. Sections that by their nature should survive (including content licenses needed to wind down, disclaimers, limitation of liability, indemnification and dispute terms) survive termination.
16. Changes to the Service and these Terms
We may modify or discontinue any part of the Service at any time. We may update these Terms; if changes are material, we will give notice (for example on the site or by email) before they take effect. Continuing to use the Service after changes take effect means you accept them. If you don't agree, stop using the Service and cancel your subscription.
17. Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which the operator of Beastify is established, without regard to conflict-of-laws rules. Before filing a claim, you agree to contact us at [email protected] and try to resolve the dispute informally for at least 30 days. Subject to the next paragraph, the courts located in the jurisdiction in which the operator of Beastify is established have exclusive jurisdiction, and you and we consent to their jurisdiction.
To the extent permitted by law, all claims must be brought in an individual capacity and not as a plaintiff or class member in any purported class, collective or representative proceeding, and any claim must be brought within one year after it arose. If you are a consumer residing in the EU, UK or another country whose laws give you mandatory protections, nothing here deprives you of those protections or of the right to bring proceedings in your country of residence.
18. General
These Terms and the Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, it will be limited to the minimum extent necessary and the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. We are not liable for delays or failures caused by events beyond our reasonable control. Notices to us must be sent to [email protected].
